Terms of Service

1. Acceptance of Terms

By accessing or using PropFollow ("Service"), you agree to be bound by these Terms. If you are using the Service on behalf of an agency, you represent you have authority to bind that agency. If you do not agree to these terms, you must discontinue use of the platform immediately.

2. Description of Service

PropFollow is a lead tracking SaaS for Malaysian Real Estate Negotiators (RENs). We provide digital tools to share property listings and track buyer engagement metrics via custom tracking links.

3. Eligibility & REN Compliance

You must hold a valid REN tag issued by the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEP / LPPEH) Malaysia to utilize the paid tiers of the platform.

You are solely responsible for ensuring your use of this tracking software remains in complete compliance with the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 and active BOVAEP guidelines. PropFollow is strictly a software utility tool, not a licensed estate agency.

4. User Accounts

You must provide accurate, current information during registration and keep your account login secure at all times.

We reserve the right to suspend or terminate accounts that violate these Terms, host illegal content, or manipulate the platform systems maliciously. No refunds will be provided for accounts terminated due to a structural breach of these terms.

5. Acceptable Use & Fair Use Policy

You explicitly agree NOT to use the Service to:

• Share, showcase, or market properties you are not legally authorized to list.
• Send automated spam, misleading advertisements, or violate the PDPA 2010 by inputting and contacting individuals without an underlying legitimate relationship or proper consent.
• Upload malicious code, exploit backend protocols, or attempt to breach our security boundaries.
• Resell, white-label, or reverse-engineer the Service without our express, written commercial agreement.

Infrastructure Fair Use: To ensure optimal performance across our cloud infrastructure, users must adhere to reasonable usage limits. PropFollow reserves the right to temporarily restrict or throttle accounts displaying atypical data storage loads, rapid high-frequency deletion and recreation of listings to intentionally circumvent subscription tiers, or automated link traffic that threatens system stability.

6. Fees, Payment, & Taxes

Paid subscription plans are billed on a recurring monthly or annual cycle in Malaysian Ringgit (MYR). All fees are non-refundable except as specifically outlined in our platform Refund Policy.

We utilize external, third-party payment processors. PropFollow does not store credit card numbers or raw banking details on its own databases.

Manual Payment Verification: For plans activated via manual payment methods (including DuitNow QR code transfers and receipt uploads), access to paid tiers will be officially granted within 24 hours of successful receipt verification. PropFollow is not liable for any temporary loss of service or link tracking delays during this processing window.

Sales and Service Tax (SST) will be applied to billings where mandatory under active Malaysian tax law framework.

7. Intellectual Property

We retain all exclusive rights, titles, and ownership over the PropFollow software, branding, UI designs, code architecture, and proprietary link-tracking engines.

You retain full ownership over your uploaded property data, imagery, and tracked buyer leads. By uploading content, you grant us a limited, worldwide license to host, display, and process this information solely to deliver the tracking services requested by your account.

8. Data Protection & PDPA 2010 Compliance

Role Identification: In terms of buyer tracking data collected via the links you share, you (the REN or Agency) act as the Data Controller (Data User). PropFollow acts strictly as a Data Processor operating the digital infrastructure.

Consent Warranty: You explicitly warrant and represent that you have obtained a lawful basis or proper consent under the Personal Data Protection Act 2010 (PDPA) to collect, track, and monitor the engagement of any buyer whose data you route through our platform.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the software will be completely error-free, constantly accessible, or that tracked engagement will convert into real estate transactions. Any structural helper tools provided for compliance tracking are for standard operational convenience, not formal legal advice.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, PropFollow shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, lost commissions, or lost transactional data.

Our total aggregate financial liability for any single or combined claim arising out of these Terms shall not exceed the total financial amount you actually paid to us across the three (3) months immediately preceding the event giving rise to liability.

11. Indemnity

You agree to fully indemnify, defend, and hold harmless PropFollow and its operational owners from and against any third-party claims, regulatory penalties, fines, or losses (including reasonable legal fees) arising directly or indirectly from your property listings, your breach of BOVAEP rules, or your violation of user privacy rights under the PDPA 2010.

12. Termination & Dormant Accounts

We reserve the right to suspend or terminate your access to the platform at our sole discretion, without notice, for non-compliance with these Terms, system abuse, or prolonged non-payment.

Dormant Account Clean-up: PropFollow reserves the right to terminate or archive any account on our Free Tier that has shown zero administrative or link activity for a continuous period exceeding 180 days. All associated property listings and historical tracking data may be permanently deleted upon account archiving.

13. Governing Law & Localized Jurisdiction

These Terms shall be governed by, interpreted, and construed entirely in accordance with the laws of Malaysia. Any disputes, claims, or legal actions arising out of or in connection with this Service shall be subject to the exclusive jurisdiction of the relevant courts of Malaysia, with the primary filing venue strictly restricted to the courts holding jurisdiction over the platform owner's registered operations in Kuching, Sarawak.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time to reflect software changes or legislative adjustments. Continued use of the platform following an update implies complete acceptance of the new conditions. Any material modifications fundamentally impacting your subscription rights will be notified to your registered email address.
